Acceptable Use Policy

Overview

This Acceptable Use Policy ("AUP") governs the use of iHealthcare, Inc.'s ("iHealthcare") products, services, platforms, and infrastructure, including iHealthConnect and all associated applications (collectively, the "Services"). By accessing or using the Services, you agree to comply with this AUP. This policy applies to all users, including covered entities, business associates, clinicians, administrative staff, and any other authorized individuals.

1. Permitted Uses

You may use the Services only for lawful purposes and in accordance with your service agreement. Permitted uses include:

  • Clinical documentation, charting, and care coordination within your authorized organization.
  • Scheduling, billing, revenue cycle management, and administrative workflows as provided by your subscription.
  • Accessing and exchanging patient health information in compliance with HIPAA, applicable state law, and your organization's policies.
  • Integrating with authorized third-party systems via iHealthcare's supported APIs and interoperability features.
  • Generating reports and analytics for internal quality improvement and operational purposes.

2. Prohibited Uses

You may not use the Services to:

2.1 Unlawful Activity

  • Violate any applicable federal, state, or local law or regulation, including HIPAA, HITECH, the False Claims Act, or anti-kickback statutes.
  • Access, use, or disclose Protected Health Information (PHI) without proper authorization.
  • Engage in healthcare fraud, upcoding, billing for services not rendered, or any other fraudulent activity.

2.2 Security Violations

  • Attempt to gain unauthorized access to any part of the Services, other accounts, or iHealthcare's infrastructure.
  • Probe, scan, or test the vulnerability of any system or network without express written authorization from iHealthcare.
  • Introduce malware, viruses, ransomware, or any other malicious code into the Services.
  • Circumvent, disable, or interfere with security features, authentication mechanisms, or access controls.
  • Use automated tools, bots, or scripts to access the Services in a manner that exceeds normal usage patterns or degrades performance for other users.

2.3 Data Misuse

  • Harvest, scrape, or collect patient data or other user data from the Services without authorization.
  • Use patient data for marketing, research, or any purpose not permitted under HIPAA or your organization's authorization.
  • Share login credentials or allow unauthorized individuals to access the Services using your account.
  • Export, copy, or transfer data from the Services in violation of your service agreement or applicable law.

2.4 Interference and Abuse

  • Interfere with or disrupt the integrity or performance of the Services or the data contained therein.
  • Conduct denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks against iHealthcare or its users.
  • Reverse engineer, decompile, or disassemble any component of the Services.
  • Resell, sublicense, or otherwise commercialize the Services without express written authorization.

3. User Responsibilities

  • You are responsible for all activity that occurs under your account credentials.
  • You must immediately notify iHealthcare of any unauthorized use of your account or any known or suspected security breach at [email protected].
  • You must ensure that all users within your organization who access the Services are aware of and comply with this AUP.
  • You are responsible for maintaining the confidentiality of your login credentials and implementing appropriate access controls within your organization.

4. Monitoring and Enforcement

iHealthcare reserves the right to monitor use of the Services to ensure compliance with this AUP and applicable law. iHealthcare may investigate suspected violations and may cooperate with law enforcement authorities. Violations of this AUP may result in immediate suspension or termination of access to the Services, without notice, in addition to any other remedies available at law or in equity.

5. Reporting Violations

If you become aware of any violation of this AUP, please report it promptly to [email protected]. Reports may be made anonymously.

6. Changes to This Policy

iHealthcare may update this AUP at any time. We will notify users of material changes via email or through a notice within the Services. Continued use of the Services after the effective date of any changes constitutes acceptance of the revised AUP.

7. Governing Law

This AUP is governed by the laws of the State of Florida, without regard to its conflict of law provisions, and is incorporated by reference into your service agreement with iHealthcare, Inc.
